13. ASTD public policy update—U.S. Department of Transportation issued a Notice of Proposed Rulemaking (NPRM)

On December 26, 2007, the U.S. Department of Transportation issued a Notice of Proposed Rulemaking (NPRM) that would for the first time establish minimum training standards for some entry-level truck and bus drivers.

While current law requires applicants for commercial driver’s licenses (CDLs) to pass certain knowledge and skill tests, there is technically no training requirement to receive a license. The proposed rule would set required content areas and establish minimum hours for both classroom and behind-the-wheel training. Applicants would be required to present a certificate of training completion to the state licensing authority in order to receive their CDL. Training providers and programs offered by employers would require accreditation by either the U.S. Department of Education or the Council for Higher Education.

The proposed rules would not take effect until three years after the final rules are issued, so individuals who currently possess a CDL or who receive it prior to that date would not be subject to the training requirements. Click here to view the NPRM. The public comment period on the proposed rule changes runs through March 25, 2008.
